Terms and Conditions

  1. Service. The date, location, and Tuition for your specific Photography Workshop shall be those set forth on the webpage for your Workshop (the “Webpage”). During the Workshop, Living Sky Photography Tours shall provide in-field photography instruction and location guidance as detailed on the Webpage (the “Services”). While lodging, food and transportation recommendations will be made whenever possible, Living Sky Photography Tours does not provide, and bears no responsibility for providing, transportation, lodging, or meals during the Workshop (unless otherwise stated on the Webpage).
  2. COVID-19 Operating Procedures. While the Workshop is primarily an outdoor activity and the risk of transmission of COVID-19 is inherently low while outdoors, some activities necessitate the need to be indoors together where the risk of transmission is higher. By signing up for the Workshop, the client acknowledges and understands the inherent risk of transmission in a Workshop and will not hold Living Sky Photography Tours liable for any expenses incurred (medical or otherwise) as it relates to COVID-19. There will be some instances when social distancing cannot be observed. These include but are not limited to carpooling, post-processing classroom situations, in-field instruction, some accommodation situations. In these instances, participants may choose to wear a mask.
    1. Individual Responsibilities during the Workshop:
      1.         Do not attend a workshop if you have tested positive for COVID-19 or have had close contact with someone who has tested positive within 14 days prior to the start of the workshop.
      2.         Avoid touching your face.
      3.         Wash or sanitize your hands frequently using proper handwashing techniques.
      4.         Observe masking orders as per Government of Saskatchewan Public Health Orders
    1. Instructor Responsibilities during the Workshop:
      1.         Follow all procedures listed above.
      2.         Conduct a pre-workshop briefing with participants reviewing these guidelines and addressing questions.
  1. Cancellation by Living Sky Photography Tours. Living Sky Photography Tours reserves the right to cancel the Workshop due to inadequate enrollment that makes the Workshop economically infeasible, or because of good-faith concerns with respect to the safety, health, or welfare of participants. Cancellation decisions shall be made at the sole and absolute discretion of Living Sky Photography Tours. If a Workshop is cancelled prior to commencement, you will be given a full refund of all Tuition paid for the Workshop. If a Workshop is cancelled in progress, you will receive a prorated refund based on the number of days (or hours for one-day workshops) not completed. For specific COVID-19 and Public Health Order cancellations, please see the policy below.
  2. Force Majeure. Neither party shall be in breach nor liable for delay in performing or failure to perform if such delay or failure results from events, circumstances or causes beyond their reasonable control, including but not limited to: natural disasters or acts of God; acts of terrorism; government acts, closures or orders; epidemics, pandemics, outbreaks of communicable disease, or other public health crises; quarantine; national or regional emergencies; or any other event out of the parities’ control, whether similar in kind to the foregoing or otherwise (“Force Majeure Event”). Written notice of a party’s failure or delay in performance due to a Force Majeure Event must be given to the other party no later than five (5) business days following the Force Majeure Event commencing, which notice shall describe the Force Majeure Event.
  3. Photographs and Video by Living Sky Photography Tours and its sub-contractors & Use of Likeness. Living Sky Photography Tours reserves the right to take photographs and videos or hire a third party to take photographs and videos during the operation of any Workshop and to use the resulting photographs or videos during the operation of any subsequent Workshop or for commercial or promotional purposes, and you agree to allow your likeness to be used for those purposes without compensation. You grant Living Sky Photography Tours a non-exclusive worldwide irrevocable license to use those videos or photographs for editorial, promotional, and training purposes. However, Copyright to all photographs and videos that you take during the Workshop shall belong to you. If you prefer that your likeness not be used by Living Sky Photography Tours, you must notify us in writing prior to the commencement of your Workshop.
  4. Assumption of Risk; Release of Liability; Indemnification. You acknowledge that Workshops and outdoor adventure photography, in general, carry an inherent risk that cannot be controlled or limited by Living Sky Photography Tours. You therefore freely assume all risks associated with the Workshop as well as other risks that cannot be predicted, and any harm, injury or loss that may occur to you or your property as a result of your participation in the Workshop. You agree to release Living Sky Photography Tours and its agents from all liability, causes of action, claims and demands that arise in any way from any injury, death, loss or harm that occur to you or to your property during the Workshop, including claims for the negligence of Living Sky Photography Tours. You also agree to indemnify, hold harmless and defend Living Sky Photography Tours against any and all claims by third parties arising out of any acts committed by you, including acts of negligence, during the Workshop. You agree to provide Living Sky Photography Tours with a signed Waiver of Liability provided to you after payment of Tuition.
  5. Travel Documentation. Participants are responsible for obtaining any documents required for their participation in the Workshops such as a valid passport, all visas, vaccination certificates, and any other documents. Failure to obtain documents does not negate the terms and conditions, and any extra costs incurred for rerouting due to travel without the necessary documents will be the participant’s responsibility.

PAYMENT AND CANCELATION POLICY

Your deposit guarantees your spot on the workshop and is nonrefundable. If you wish to protect the expenses you have invested in the workshop, I highly recommend purchasing travel insurance. It is a very affordable and widely available way to protect your purchase in the event of unforeseen circumstances. Such insurance often provides coverage for losses suffered in the event of trip cancellation and interruption, travel delay, loss of baggage and travel documents, baggage delay, medical emergencies and accidental death.

The total cost payable to Living Sky Photography Tours for any given Photography Workshop is listed directly on the webpage for each individual Workshop as the “Investment” (Henceforth called Tuition). Tuition for all Workshops are subject to the terms of this Payment & Cancelation Policy, as well as the Terms & Conditions provide on this website.

Tuition for each Workshop will be paid in one of two methods: (1) In full upon registration; or (2) through a non-refundable deposit made at the time of registration and the remaining Tuition balance due no later than sixty (60) days prior to your Workshop’s start time. If full Tuition is not received by the date that it is due, Living Sky Photography Tours reserves the right to cancel your reservation and retain any deposit or payments made toward your Tuition.

Should you need to cancel your registration for any reason, you must send a notice of cancellation to Living Sky Photography Tours in writing, which will become effective as of the date sent (i.e., the date postmarked for standard mail, or the date/time sent for electronic communications).

  1. Where notice of cancellation is received by Living Sky Photography Tours sixty (60) days or more before the day your Workshop begins, you shall forfeit your non-refundable deposit (for Workshops where a deposit is required) but shall not be liable for the remaining tuition balance. Because cancellations require us to re-open enrollment and/or to engage in additional promotional efforts to fill the workshop on short notice, our policy is that there will be no refunds of the deposit. However, at the sole discretion of Living Sky Photography Tours, your non-refundable deposit less any incurred expenses such as insurance, licensing, promotional costs, etc. can be credited to an alternate workshop run by Living Sky Photography Tours if:
  •              Notice is received sixty (60) days or more before the day your workshop begins and;
  •              We find participants to fill all cancelled spaces and the workshop is ultimately full when it begins.
  1. Where notice of cancellation is received by Living Sky Photography Tours sixty (60) days or less before the day your workshop begins you shall forfeit your non-refundable deposit and the remaining tuition balance (for Workshops where a deposit is required). In this scenario, your balance (excluding your non-refundable deposit) may be credited to an alternate workshop run by Living Sky Photography Tours if:
  •              We find participants to fill all cancelled spaces and the workshop is ultimately full when it begins.

All refunds are subject to a 4% processing fee and will be processed within two weeks of the workshop’s conclusion.

COVID-19 Cancellation and Postponement Policy

If your Workshop is postponed or cancelled due to COVID-19 or Public Health Orders thirty (30) days or more before the Workshop begins, the above cancellation policy where notice of cancellation is received sixty (60) days or more before your Workshop begins will apply.

As a small business in the global travel industry, Living Sky Photography Tours is greatly affected by global outbreaks such as COVID-19, and we cannot provide mass refunds where Covid-19 or Public Health Orders result in the cancellation of a Workshop less than thirty (30) days before the Workshop begins. There is a ‘no-refund policy’ in the case of Covid-19 and Public Health Orders. This applies if your local travel restrictions related to COVID-19 prohibit you from attending the workshop. It is your responsibility to provide written notice of such restrictions to Living Sky Photography Tours if they prohibit you from attending the Workshop at the earliest convenience. At the sole discretion of Living Sky Photography Tours, your tuition less any incurred expenses such as insurance, licensing, promotional costs, etc. can be credited to an alternate workshop run by Living Sky Photography Tours

If Covid-19 or Public Health Orders by the Government of Saskatchewan prohibit us from running the Workshop on the dates listed on the Webpage, a reasonable effort will be made to postpone the workshop until such a time as it becomes possible to host the Workshop again. In the case you are unable to attend the Workshop on the postponed date, your Tuition will be transferred to an alternate workshop run by Living Sky Photography Tours less any expenses already incurred such as insurance, licensing, promotional costs, accommodations, etc.
